N43158 Piper Warrior - DISPUTE

There is ongoing litigation regarding N43158. The owner if N43158, Robert Corona (owner of All Pets Animal Hospital), has refused to refund my $5000 deposit while continuing to try to sell this plane.

Agreement

On 11/05/2024 I entered into a purchase agreement to buy N43158 from Robert Corona. The purchase agreement states thatin the event the airplane is not determined to be in acceptable state, at the sole discretion of the Buyer, the deposit shall be immediately refunded.

Inspection

Among the inspections findings was that after the engine overhaul, Robert Corona filed to follow mandatory post-engine-overhaul requirements as specified in Lycoming Service Instruction No. 1427C

Cancellation

In early December 2024, I notified the broker, Vaughn Aprahamian, and the seller, Bob Corona, of my decision to cancel the purchase and requested return of the deposit pursuant to the agreement.

Refusal

At first the broker, Vaughn Aprahamian, suggested that the seller would refund my deposit. When that didn't happen in a reasonable timeframe I reached out directly to the owner, Robert Corona (owner of All Pets Animal Hospital). Bob has refused to refund the deposit.

Small Claims

On 12/12/24 I initiated a case against the seller in small claims court. The case is scheduled to be heard mid-February 2025.

Listing on Trade A Plane

Despite continuing to hold my deposit and despite the scheduled court case, Vaughn and Bob re-listed the plane on Trade-a-Plane. It's clear that Robert Corona intends to sell the plane and keep my deposit.
